Notice of Pending Application and Public Hearing for Proposed Wetland Individual Permit - Extension of Thackeray Trail

The City of Oconomowoc via Public Works Director Mark Frye, 174 E Wisconsin Avenue, Oconomowoc, WI 53066 has applied to the Department of Natural Resources (Department) for a permit for wetland fill or disturbance associated with roadway improvements proposed for the area between the current dead end of Thackeray Trail and Silver Lake Street, south of St. Jerome’s Church.

The proposed project will connect existing Thackeray Trail between Silver Lake Street and the existing dead end of Thackeray Trail south of Oconomowoc High School. This is west of the Whitman Park Shopping Center adjacent to STH 67. A multi-purpose recreational trail is planned adjacent to the proposed low-speed, 2-lane road extension providing bicyclists and pedestrians a safer route. Recurring flooding issues along Thackeray Trail, near Emerson Drive, may be improved by diverting a portion of storm water runoff to the south side of the road near the current dead end.

The roadway project is located in the NE1/4 of the SW1/4 of Section 04, Township 07 North, Range 17 East, City of Oconomowoc, Waukesha County. Locally known as the Thackeray Trail Street Extension to Silver Lake Street.

The Department will review the proposal provided by the applicant and any information from public comments and the public informational hearing. The Department will determine whether the proposal complies with ss. 1.11 and 281.36, 401 CWA, Stats., and ch. NR 150, Wis. Adm. Code, and ensure that the required mitigation meets the standards in s. 281.36(3r), Stats. if the project impacts wetlands.

The Department has made a tentative determination that it will modify the permit or contract for the proposed activity.

The public hearing is scheduled for Monday, January 28, 2019 from 4pm to 6pm at Oconomowoc City Hall, Council Chambers (2nd Floor) 174 E. Wisconsin Avenue, Oconomowoc, WI 53066. If arriving after 5pm, please enter on the St. Paul Street side of the building.

The Department scheduled a public hearing on this activity or project because the Department received a request for a public hearing. The hearing will be a public informational hearing where members of the public can learn more about the proposed activity and submit written or oral comments about the wetland impacts in light of the legal standards above.

Any member of the public may submit written comments by emailing Craig.Webster@Wi.Gov or writing to Craig Webster, DNR, 141 NW Barstow St., Room 180, Waukesha, WI 53188 by U.S. mail. Comments should include the docket number or applicant name and should relate to whether the project meets the legal standards listed above. Comments must be postmarked no later than 10 days after the date that the public informational hearing is completed in order for them to be considered.

The final decision may be appealed as indicated in the decision document.
